What is Loan Forgiveness?

Loan forgiveness is not one program but a series of programs created by the Department of Education under the William D Ford Act. These programs include the PAYE, Public Service Loan Forgiveness, Teacher Loan Forgiveness, Closed School Discharge, Perkins Loan Discharge, Total and Permanent Disability Discharge and Borrowers Defense to Repayment

What are the eligibility requirements for the forgiveness programs?

First, you must have had no outstanding balance on a Direct Loan or Federal Family Education Loan (FFEL) Program loan when you received a Direct Loan or FFEL Program loan on or after Oct. 1, 2007.

Second, you must have received (a) a disbursement of a Direct Subsidized Loan, a Direct Unsubsidized Loan, or a Direct PLUS Loan for students on or after Oct. 1, 2011; or (b) a Direct Consolidation Loan based on an application that was received on or after Oct. 1, 2011.

Are loan amounts forgiven under PAYE/Forgiveness programs considered taxable by the IRS?

No. According to the Internal Revenue Service (IRS), student loan amounts forgiven under PAYE aren’t considered income for tax purposes. For more information, check with the IRS or a tax advisor.

Does my income level determine my eligibility for PAYE?

There is no income requirement to qualify for the PAYE or other income driven programs. However, since your required monthly payment amount under most of the qualifying repayment plans is based on your income, your income level might be a factor in determining whether you have a remaining loan balance to be forgiven after making 240 qualifying payments.

Can I be certain that the PAYE/Forgiveness Programs will exist by the time I have made my qualifying payments?

We can’t make any guarantees about the future availability of PAYE. The PAYE/IDR Programs were created by Congress, and Congress could change or end the PAYE Program.
